Everyone is talking about the California Supreme Court’s new “ABC Test” for distinguishing employees from independent contractors in the case known as Dynamex. But knowing the new ABC Test is not enough. A few weeks after Dynamex, a Court of Appeal decided a different case that also dealt with the ABC Test when an employee is shared by multiple employers. And now the California Legislature is getting involved with proposed Assembly Bill 5 that would regulate how to determine independent contractors.
